Mr & Mrs B from Bradford were due to travel with Jet2.com from Tenerife South Airport to Leeds Bradford in August 2011 when their flight was unexpectedly cancelled at the last minute due to a technical fault.
Mr & Mrs B wrote to Jet2.com directly and Jet2.com refused to pay compensation arguing that the delay was due to a technical fault which amounted to an ‘extraordinary circumstance’. Jet2.com also argued that Mr and Mrs B had not brought their claim within two years. According to the airline, this was the time limit stipulated in their General Terms and Conditions of Carriage.
Mr & Mrs B fought Jet2.com for two years. They even wrote to the Spanish civil aviation authority, AESA, who confirmed that, in their view, Jet2.com had not duly proved extraordinary circumstances and that compensation of €400.00 per passenger should be paid by Jet2.com. Jet2.com refused to accept the findings of the AESA and again said that they would not pay any compensation.
Mr & Mrs B then contacted the team at Jefferies Solicitors. We sent a letter of claim to Jet2.com, confirming Mr & Mrs B’s intention to commence legal proceedings against the airline. Within three weeks, Mr & Mrs B were delighted to receive a cheque in the sum of €800.00 from Jet2.com.
