CIRCUMSTANCES
The client was working as a train door engineer and was required to use their own tools including a Stanley knife to cut the rubber trim on a train door. No training in using knives or protective gloves was given. The client trimmed the rubber and as they did so, the knife slipped causing the client to sustain severe personal injury and damage. After the incident training/handouts were supplied on the use of knives, PPE was made available, and employees were told to wear gloves when using a knife.
INJURIES
The client suffered lacerations and tendon damage to a hand. The damage was so severe that the client required 2 operations and still does not have full use of the hand. The client required 9 months off work, plus another 3 months after surgery, because of the accident, they were unable to return to work as an engineer due to the loss of hand function. The loss of function also resulted in the client being unable to play their hobbies of golf and snooker.
SETTLEMENT
Our client instructed Jefferies in August 2020 and was represented by Crystal Collins.
