A young woman, who suffered a severe traumatic brain injury in a car accident, has received a multi-million-pound settlement which will provide her with the specialist care, therapies and support she will require for the rest of her life.

The woman was a passenger in a car when she was involved in a head-on collision in 2013. As a result of the accident, she was left with a permanent brain injury and continuing cognitive and behavioural impairments.

Her condition means that the woman, who cannot be named for legal reasons, suffers from overwhelming fatigue which has a significant impact on her functional capabilities. She also now suffers from seizures and has issues with anxiety.

At the time of the accident, she was a bubbly, popular and independent young woman with a full social circle and a job she loved. The accident had a devastating effect on the young woman and also on her family and friends.

The young woman attempted to return to work several months after the accident. Unfortunately, she struggled significantly with fatigue and episodes of altered consciousness and 18 months following her accident, her employment was terminated.

The cognitive impairments she was left with as a result of her injury also made it very difficult for her to carry out day-to-day domestic duties such as meal preparation managing her finances or housework.

How our serious injury solicitors helped

Shortly after her accident, the woman’s parents instructed specialist brain injury lawyers at Jefferies Solicitors to handle her case.

After liability was admitted, we were able to obtain interim funds early for case management intervention and a private rehabilitation regime. As a result, the young woman was supported by a dedicated case manager while the legal process was ongoing.

Court proceedings were issued in December 2016. There followed lengthy negotiations with the Solicitors acting for the insurer of the third party while the matter progressed through the Court. After preparing detailed witness statements and obtaining expert medical evidence, we secured a formal settlement of £3 million, which was approved in January 2019 in the High Court.

The money will fund the specialist care, support and therapies this young woman will require for the rest of her life. It will also compensate for her loss of earnings.

“While no settlement can ever truly compensate someone for the severe and lifelong injuries suffered I am very pleased we were able to secure this outcome.  It was a privilege to act for this young lady, to work closely with her and her family and witness how well they pulled together and coped in the face of adversity.”

Nina Ramsden, Director and Senior Solicitor

    The woman’s parents said:

“At a time of true sadness, despair and fear for what the future held for our daughter, the professionals at Jefferies gave us hope and comfort.

No money can ever replace the daughter we lost on that day but we now have some peace of mind in providing her future care and treatments for the rest of her life.

We will forever be indebted for the hope and kindness shown to us all through some of the most testing times.”
